PASSIVE INFORMATION COLLECTION

We will only transmit personal information outside the country in which it was collected if:

  • This transmission is necessary for the execution of a contract between you and Integra LifeSciences or to make pre-contractual arrangements in response to your request; or
  • That you consent to such transmission; or

Integra LifeSciences has arrangements with all of its offices and subsidiaries to ensure sufficient protection of personal information exchanged by Integra LifeSciences companies, including personal information (possibly including sensitive information) exchanged with Integra LifeSciences companies in the United States.

DATA RELATED TO CHILDREN 

We will not knowingly collect personal information from anyone under 13 without the consent of a parent or guardian. In addition, we may limit how we collect, use, and store some of the information of EU users between 13 and 16. In some cases, this means we will be unable to provide certain functionality to these users. If we need to rely on consent as a legal basis for processing your information and your country requires consent from a parent, we may require your parent’s consent before we collect and use that information.

ARTIFICIAL INTELLIGENCE (A.I.) ADDENDUM

WHAT IS ARTIFICIAL INTELLIGENCE (A.I.)?

Artificial Intelligence (A.I.) is software that is programmed with data sets, algorithms and computer models. This programming allows systems, machines, and tools to perform tasks normally associated with human intelligence such as problem solving and decision making.


TRANSPARENCY ABOUT A.I. USAGE

Integra may utilize software, platforms or systems (third party and internal) that use Artificial Intelligence (A.I.) during regular operations, in manufacturing, data analysis, record management, marketing campaign development or when providing customer services. If A.I. is used, a disclosure will be provided which shares this information. Human engagement and monitoring will also accompany the input and output of A.I. platforms.


WHAT DATA IS COLLECTED AND PROCESSED

Integra may collect personal data with the help of A.I. supported systems (such as name, address, phone, facility information, browsing history, IP address etc.). Personal data may be shared with third-party companies or service providers in support of Integra activities or in collaboration for ongoing projects. 


ACCOUNTABILITY AND ADHERENCE TO DATA PROTECTION LAWS

Personal information provided to or collected by Integra will not be used for training models and will not be provided to third parties for data set and platform development.  All personal and sensitive information will be collected, managed and stored, per data protection laws, such as GDPR, EU AI Act, CCPA and other applicable state laws. All personal information collected will be maintained to ensure data integrity, confidentiality and security. 


DATA MINIMIZATION, ANONYMIZATION AND PSEUDONYMIZATION

Integra will only collect information and process personal information that is directly and specifically relevant to the stated purpose or function and will not be used for unrelated purposes or activities without the collection of additional consent. Information will only be utilized or stored for the duration related to the specific activity, project or purpose that it was collected for. Data will still be maintained and stored if required to meet legal requirements or if company record retention parameters have not been met.

Pseudonymization and anonymization practices will be applied to personal data when appropriate and applicable to protect personal data. Personal Information may not be used for general A.I. data set addition or A.I. model training internally or provided to third parties for these purposes.


SECURITY

Personal data will be protected from loss, unauthorized access, destruction, use, modification, or disclosure via encryption, secure data storage and handling procedures, access controls and regular security audits.


DATA SUBJECT RIGHTS

If personal data is collected and used by an A.I. platform that is being utilized but Integra, you have the right to access, correct, update, erase, restrict processing, data portability, and the right to object to automated decision-making.

ACCURACY, FAIRNESS AND NON-DISCRIMINATION

Data provided to Integra for use with A.I. systems and services will be reviewed for accuracy and if it is current to work to reduce bias. Integra is committed to ensuring that its systems and software handle personal information in a fair and accurate manner to reduce or eliminate biased outcomes. Diverse datasets and human audits and reviews are also implemented to help reduce any bias in results from A.I. processing.


STATE-SPECIFIC PRIVACY INFORMATION 

CALIFORNIA

SUPPLEMENTAL PRIVACY NOTICE FOR CALIFORNIA RESIDENTS 

This notice for California residents supplements the information contained in our Privacy Policy and applies solely to residents of the State of California. We have provided this supplemental information pursuant to the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used here. Use or Disclosure of Personal Information 

In the past 12 months, we have used or disclosed the personal information we collect for our operational purposes and for one or more of the following business purposes:

How We Share Personal Information 

Integra will not share consumers’ personal information with an unrelated third party without permission, except as described below. Integra may share personal information with any member of our corporate group, including parent companies, subsidiaries, and affiliates, and other companies in which we have an ownership or economic interest for purposes that are consistent with those identified in our Privacy Policy and this Supplemental Privacy Notice.

In the ordinary course of business, we will share some personal information with companies that we hire to perform services or functions on our behalf. In all cases in which we share consumers’ personal information with a third party, we will only allow them to keep, disclose, or use consumers’ information to provide the services we asked them to provide.

We may be required to release consumers’ personal information in response to a court order, subpoena, search warrant, law, or regulation. We may cooperate with law enforcement authorities in investigating and prosecuting users who violate our rules or engage in behavior which is harmful to other users or illegal. We do not sell personal information of California consumers except as part of a sale, merger, dissolution, or acquisition of the business.

This does not include disclosures that are not a “sale” under the CCPA, including when

We do not sell personal information of California consumers, including minors.

Rights under California Law 

  1. Right to Access. If you are a California consumer, you have the right to ask us to send you the following information up to two times in a twelve-month period:

  2. Right to Delete. If you are a California consumer, you have the right to ask us to delete the personal data about you we have collected. We may deny the request if the information is necessary to:
    • complete a transaction, including providing a requested or reasonably anticipated good or service, or fulfill a contract between the consumer and Integra;
    • detect and protect against security incidents, malicious, deceptive, fraudulent, or illegal activity, or take against those responsible for such activity;
    • debug to identify and repair errors impairing intended functionality;
    • exercise free speech or another right provided for by law;
    • comply with the California Electronic Communications Privacy Act;
    • engage in research in the public interest adhering to applicable ethics and privacy laws where the consumer has provided informed consent;
    • enable solely internal uses reasonably aligned with the consumer’s expectations based on the consumer’s relationship with Integra;
    • comply with a legal obligation; or
    • otherwise use the information internally in a lawful manner compatible with the context in which the consumer provided the information.
  3. Right to Opt-out. If a business sells personal information to third parties, California consumers have the right, at any time, to opt out of the sale or disclosure of their personal information to third parties. Integra does not sell personal information to third parties.

You do not have to create an account with us to submit a request.

Your request will be confirmed within 10 days of receipt and we will respond within 30 days. If we need more than 30 days, we will notify you that your request is being delayed.

We can only respond to your request if it is verifiable. This means we are obligated to take reasonable steps to verify your identity or your authorized agent’s authority and your right to access the information you request. We may ask for additional information that will help us do so. We will only use that additional information in the verification process, and not for any other purpose.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

CALIFORNIA 'DO NOT TRACK' DISCLOSURES

California law (CalOPPA) requires Integra to let you know how we respond to web browser 'Do Not Track (DNT) signals'.  Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not honor Do Not Track requests at this time.


CHINA PERSONAL INFORMATION PROTECTION LAW (PIPL)

CHINA PERSONAL INFORMATION PROTECTION LAW (PIPL) ADDENDUM

This addendum supplements our global privacy policy and applies to the processing of personal information of individuals located in the People’s Republic of China (PRC), excluding Hong Kong, Macau, and Taiwan, in accordance with the Personal Information Protection Law (PIPL) effective November 1, 2021.

APPLICABILITY 

  • Processing of personal information within the PRC.
  • Processing outside the PRC targeting PRC individuals or analyzing their behavior.

DEFINITIONS

  • Personal Information (PI): Data identifying or identifiable to a natural person, excluding anonymized data.
  • Sensitive Personal Information (SPI): Includes biometric data, religious beliefs, health, financial accounts, geolocation, and national ID numbers.
  • Processing: Includes collection, use, storage, transmission, disclosure, and deletion.

LEGAL BASIS

  • Individual consent.
  • Contractual necessity.
  • Legal obligations.
  • Public health or safety.
  • News/public interest (as permitted by law).

CONSENT

  • General Consent: Required for non-sensitive PI.
  • Separate Consent: Required for SPI, third-party sharing, and cross-border transfers.
  • Withdrawal: Individuals may withdraw consent at any time.

COLLECTION

Additional PI collected may include:

  • National ID numbers.
  • Medical device usage data.
  • SPI (with separate consent and necessity explanation).

CROSS-BORDER TRANSFERS

  • CAC security assessment is passed.
  • CAC standard contracts are signed.
  • Certification is obtained.

Individuals must be informed and provide separate consent.

INDIVIDUAL RIGHTS

  • Be informed of processing details.
  • Access, copy, correct, or delete PI.
  • Withdraw consent.
  • Object to automated decision-making.
  • Allow next of kin to exercise rights posthumously.

PROCESSOR OBLIGATIONS

  • Process lawfully, justly, and necessarily.
  • Implement security measures.
  • Maintain processing records.
  • Retain PI only as needed.
  • Notify authorities and individuals of breaches.
  • Appoint a local PRC representative.

MINORS

Processing PI of children under 14 requires parental consent.

THIRD PARTIES

  • Comply with PIPL.
  • Undergo audits.
  • Sign data processing agreements.
